Policy”) applies to our website,
www.buymyspot.com, and associated mobile application (collectively, the “
Site”). This Policy describes how BUYMYSPOT, LLC and its related companies (the “
Company”, “
us”, “
our”, and “
we”) collect, use and share personal information of individuals who use or access our Site (“
you” and “
your”). This Policy also applies to any of our other websites that post this Policy. This Policy does not apply to websites that post different statements.
If you do not agree with our policies and practices, your choice is not to use our Site. By accessing or using the Site, you agree to this Policy. This Policy may change from time to time (see Changes to This Privacy Policy). Your continued use of the Site after we make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates.
INFORMATION WE COLLECT
In order to provide you with personalized services, we collect information from and about you in a range of ways. The types of information that we collect include, but are not limited to, information:

Information You Give Us. We may collect your name, postal address, email address, phone number, location data, username, password, license plate number, driver’s license number, demographic information (including, but not limited to, your gender, your age, your occupation, your educational background, skills, and interests), messages you send to us or to other users of the Site, as well as other information you directly give us on our Site.
We log usage and other longitudinal data when you visit or otherwise use our Site, such as when you view or click on content or ads, perform a search, or reserve a parking spot. We use log-ins, cookies, device information and internet protocol (“
IP”) addresses to identify you and log your use.
You also may provide information to be published or displayed ("
Posted") on public areas of the Site, or transmitted to other users of the Site or third parties (collectively, "
User Contributions"). Your User Contributions are Posted on and transmitted to others at your own risk. We cannot control the actions of other users of the Site with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.
Information From Other Sources. We may get information about you from other sources. We may add this to information we get from the Site.

For example, when visiting our Site, we log your device operating system type, browser type, browser language, the website you visited before browsing to our Site, pages you viewed, how long you spent on a page, access times, and information about your use of and actions on our Site.

h. To enable Property Owners and Property Renters (as defined in our Terms of Use) to directly communicate;

SHARING YOUR INFORMATION
We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.
We may share Personal Information that we collect or you provide:
a. With your consent. For example, you may let us share Personal Information with third parties for their own marketing uses. Those uses will be subject to the privacy policies of those third parties.
b. When we enter into or negotiate a business deal, such as for the sale or transfer of all or a part of our business or assets. These deals can include any merger, financing, acquisition, or bankruptcy transaction or proceeding.
c. For legal, protection, and safety purposes, such as:

2. To protect the rights and property of the Company, our agents, customers, and others; this includes enforcing our agreements, policies, and Terms of Use;

SENSITIVE PERSONAL INFORMATION. While some of the information that we collect and use may constitute sensitive Personal Information, we only process such information in order to provide the Site and within other exemptions under applicable law. For example, we may process your financial information to provide you the goods or services you request from us, or we may collect your driver’s license number to verify your identity.
INFORMATION CHOICES
Refusing or Disabling Cookies. You may be able to control some of the information we collect through your device browser settings, by refusing or disabling cookies. INFORMATION REQUESTS AND PRIVACY RIGHTS
Request to Access, Correct or Delete Information Collected. You may submit a request to know, correct or delete the information we have collected about you by emailing us at help@buymyspot.com or mailing your request to the physical address provided below. We cannot delete your Personal Information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. You may appeal any decision we have made about your request. You can also submit a request to delete your account on the Site.
Your Rights. Your right to know includes what Personal Information we have collected about you, including the categories of sources from which the Personal Information is collected, the business or commercial purpose for collecting or sharing Personal Information, the categories of third parties to whom we share the Personal Information, and the specific pieces of Personal Information we have collected about you. We do not discriminate based on the exercise of any privacy rights that you might have.
California Residents. California's “Shine the Light” law (Civil Code Section § 1798.83) allows users of the Site who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please send an email to help@buymyspot.com. We may not be able to respond to certain requests if you do not provide us with adequate information. Please note that a removal request does not ensure complete or comprehensive removal of the material. For example, user content that you have Posted may be republished or reposted by another user.
Submitting Requests Through an Authorized Agent. You may be entitled, in accordance with applicable law, to submit a request through an authorized agent. To designate an authorized agent to exercise choices on your behalf, please provide evidence that you have given such agent power of attorney or that the agent otherwise has valid written authority to submit requests on your behalf. We will respond to your request in accordance with applicable law and subject to proper verification. We will verify your request by asking you to send it from the email address associated with your account or provide us with information necessary to verify your account.
DATA SECURITY AND RETENTION
Data Security. We use reasonable measures to help protect your information from loss, theft, misuse, unauthorized access, disclosure, alteration, or destruction. You should understand that no data storage system or transmission of data over the internet or any other public network can be guaranteed to be 100 percent secure. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
Please note that information collected by third parties may not have the same security protections as information you submit to us, and we are not responsible for protecting the security of such information.
Retention. We retain information for as long as it is necessary to provide you with the Site and for the other purposes set out in this Policy. We also retain information when necessary to comply with contractual and legal obligations, when we have a legitimate business interest to do so (such as improving and developing the Site, and enhancing its safety, security and stability), and to exercise or defend against legal claims.
The retention periods vary depending on different criteria, such as the type of information and the purposes for which we use the information. For example, when we process your information, such as your profile information to provide you with the Site, we keep this information for as long as you have an account. If you violate our Terms of Use, or other conditions or policies, we may remove your profile immediately, but we may keep other information about you to process the violation.
MISCELLANEOUS
Children Under the Age of 13. The Site is intended for use by persons age 18 and above, and it is not directed at children under 13 years of age. We do not knowingly collect Personal Information, including Personal Identifiable Information and Personal Viewing Information, from children under 13. If you become aware that a child under 13 has provided us with Personal Information, please contact us. If we become aware that a child under 13 has provided us with Personal Information, we will take steps to delete that information and terminate the account.
CHANGES TO THIS PRIVACY POLICY. We may change this Policy from time-to-time. If we make any changes, we will change the Last Updated date above. If we make material changes to how we treat our users' Personal Information, we will notify you through a notice on the Site homepage. You are responsible for periodically visiting our Site and this Policy to check for any changes.
